Practical guide for employers using AI-assisted interview-integrity tools | Updated September 22, 2026

Several U.S. states and localities now require employers to provide greater transparency, consent, auditability, or human oversight when artificial intelligence or biometric technology is used in hiring. The rules differ significantly: some specifically regulate AI-analyzed video interviews, while others apply only when automated tools materially influence employment decisions or process biometric identifiers. This guide summarizes the interview-related requirements most relevant to AI-assisted interview-integrity tools and provides a candidate notice for each state. Where no specific interview-AI notice law was identified, a standard transparency notice is provided as a best-practice disclosure.

IMPORTANT — NOT LEGAL ADVICE This is a practical compliance guide, not legal advice. Applicability can depend on the job location, candidate location, whether video is recorded, whether biometric templates are created, and how much automated technology influences the employment decision.

How to use this guide

  1. Find the state. Use the state where the role is based, and also check where the candidate is located. When in doubt, use the stricter template.

  2. Copy the email. Each state has a ready-to-send email. Replace every highlighted [placeholder] before sending.

  3. Send before the interview. Send the notice ahead of the interview. For New York City roles, notice is generally required at least 10 business days before use.

  4. Collect responses. Illinois (consent) and Maryland (signed waiver) require a response before AI-assisted interview monitoring is used. Keep a record of each response.

ANTI-DISCRIMINATION & RECORDKEEPING

WHAT THE LAW SAYS

California’s employment regulations regarding automated-decision systems, effective October 1, 2025, clarify that employers can violate the Fair Employment and Housing Act when automated systems used in recruiting, screening, hiring, or other employment decisions discriminate based on protected characteristics. Covered employers must retain relevant employment records, including automated-decision data, for at least four years. The regulations do not create a blanket candidate-consent requirement for every use of AI in an interview.

NOTICE REQUIRED FROM JAN 1, 2027

WHAT THE LAW SAYS

Colorado’s 2026 automated decision-making technology law applies to covered ADMTs that materially influence consequential decisions, including employment. Beginning January 1, 2027, deployers must provide clear notice at the point of interaction with a covered ADMT. After an adverse consequential decision, additional plain-language information and a right to request meaningful human review/reconsideration apply. Compliance records must generally be retained for at least three years.

WHAT THE LAW SAYS

Connecticut Public Act 26-15 creates disclosure duties for automated employment-related decision technology. Beginning October 1, 2027, a deployer generally must disclose in plain language when an applicant in Connecticut is interacting with such technology, unless that interaction would be obvious. Additional requirements apply when the technology generates output used to make, or as a substantial factor in making, an employment-related decision.

CONSENT REQUIRED

WHAT THE LAW SAYS

Illinois has a specific Artificial Intelligence Video Interview Act. When an employer asks applicants for positions based in Illinois to record video interviews and uses AI to analyze those applicant-submitted videos, the employer must, before the interview, notify the applicant that AI may be used, explain how the AI works and the general types of characteristics it evaluates, and obtain the applicant’s consent. The Act also restricts sharing and requires deletion of the interview within 30 days after a qualifying applicant request. Separate Illinois biometric law may apply if covered biometric identifiers/information are collected or stored.
